BREAKING: House of Reps warn presidency, says EFCC chairman MUST be approved by the Senate

The House of Representatives today, Thursday, April 27 warned the executive arm of government to refrain from abusing government processes.

ZENITHBLOG.com observed that the green chambers specifically hammered on the need to prevent the erosion of the doctrine of separation of powers.

The motion which was sponsored by minority leader, Honourable Leo Ogor from Delta state, provided an opportunity for lawmakers to air their grieviances against some of the actions of the executive arm of government.

Speaking in support of the motion, Honourable Simon Arabo from Kaduna state, made reference to the executive retaining an EFCC chairman who had twice been rejected by the Senate, and stating that Senate confirmation isn’t required when the EFCC Act states otherwise.

Honourable Lawan also argued in support of the motion, saying that the essence of separation of powers is compartmentalisation, that all arms are equal and separate, and none has the power to take over the functions of the other.

Debating further, Lawan stated that the disagreement surrounding the need for the Senate approval for appointment of EFCC chairman stems from Section 171(d), which states that the president can appoint perm secs & heads of extra-ministerial agencies, however designated.

He said the clause is ambiguous and nebulous, and becomes invalid when viewed alongside the EFCC Act, which states that the appointment of the chairman MUST be approved by the Senate.

“When there is a general law and a specific law on an issue, then the specific law will take precedence,” Honourable Kingsley Chinda from Rivers state added his voice in support of the motion.

The motion was adopted by the House and the green chambers resolved to

1) Urge officials of the Executive to refrain from making statements that connote the usurpation of the powers of the Judiciary, with their negative effects on the doctrine of separation of powers.

2) Also urge Mr President to approach the court for interpretation of any contrived conflict in the EFCC Act, which is an existing law in the country.

3) Mandate the C’tee on Legislative Compliance to ensure implementation.
