The National Judicial Council has forwarded its resolution where the council re-nominated Justice Walter Onnoghen as the Chief Justice of NJC while at the same time urging the acting president to extend his acting tenure for three months
The National Judicial Council (NJC) today January 8 at the end of an emergency meeting in Abuja re-nominated Justice Walter Onnoghen for appointment as the Chief Justice of NJC and consequently forwarded its resolution to the Acting President, Prof. Yemi Osibanjo hours after Onnoghen’s name was reportedly sent to the Senate for confirmation by the Presidency.
The Council was said to have taken the action because it will not be possible for the Senate which is currently on recess, to reconvene and screen Onnoghen before Friday when his constitutional three months tenure as Acting CJN would expire

in line with section 231(5) of the 1999 constitution, as amended, NJC, therefore urged the Acting President, Yemi Osibanjo to extend Onnoghen’s acting tenure for another three months.
According to Vanguard, Justice Ibrahim Tanko Muhammad signed the extension letter sent to the Presidency even though, Onnoghen is statutorily the Chairman of the NJC
“All the NJC members that attended the meeting were unanimous in the decision to re-nominate Justice Onnoghen,” a source told Vanguard.

“Except on the recommendation of the NJC”, his appointment by the president “shall cease to have effect after the expiration of three months from the date of such appointment, and the President shall not re-appoint a person whose appointment has elapsed.”
President Buhari on November 10, 2016, appointed Onnoghen as the head of judiciary in acting capacity. This followed the retirement of former CJN, Justice Mahmud Mohammed, who bowed out upon clocking the 70 years mandatory retirement age.
