Tension as CJN Onnoghen orders investigation on Sharia court judge

– The Chief Justice of Nigeria (CJN), Justice Walter Onnoghen has given a prompt direction to the Chief Judge of Sokoto state, Justice Bello Abbas

– Onnoghen directed Justice Abbas to commence necessary action against a Sharia court judge in the state

– The CJN’s actions was informed by the two petitions he received against the judge

The CJN, Justice Walter Onnoghen has directed the Chief Judge of Sokoto state, Justice Bello Abbas to commence necessary action against a Sharia court judge in the state.

The CJN in a letter signed by the Secretary of the National Judicial Council (NJC), Danladi Halilu forwarded two petitions dated April 3, by Malam Hassan Ahmed Danbaba and his counsel Yusuf Dankofa against a lower court judge in the state.

The letter said the petitions “against the lower court judge” were forwarded to the Sokoto CJ “for necessary action of the Sokoto state Judicial Service Commission.”

Danbaba, a senior counselor in the Sultanate Council of Sokoto, petitioned the CJN to wade into an alleged subversion of justice by Justice Umar Sifawa, a judge of the state Sharia court.

Justice Sifawa in March this year issued a bench warrant for the arrest of Danbaba. The order was given in a ruling on a motion filed by the National Vice Chairman of the All Progressives Congress (APC), North-West, Alhaji Inuwa Abdulkadir accusing Danbaba of defamation of character.

A leaked letter allegedly written by Danbaba and addressed to the state governor, Aminu Tambuwal on December 31, 2016 had allegedly described Abdulkadir’s late father as a slave bought by one Gwaggo, for two shillings, and that his mother died as a cook in primary school.

However, in the petition addressed to the CJN, dated March 24, Danbaba contended that Justice Sifawa had made a

mockery of the entire Shariah court system in Sokoto state in a matter between him and Abdulkadir.

Danbaba who is the Magajin Garin Sokoto demanded the immediate probe and dismissal of Justice Sifawa from service for allegedly violating his oath of office by acting in a bias and prejudicial manner.

He also filed a motion on notice praying for the stay of the court’s proceedings, pending the determination of his appeal at the State High Court asserted that the Sharia court breached his right to fair hearing and fair trial.

The late Sardauna of Sokoto’s grandson had in the petition filed on his behalf by his counsel, Mr Yusuf Dankofa and also addressed to the Grand Khadi Sokoto state asserted that he was wrongfully served a criminal summons through a proxy to appear at the Sokoto Upper Area Sharia court to answer to some allegations leveled against him by Abdulkadir.

“Sir without fair hearing, the court sat and out of manifest bias issued a bench warrant against our client when the judge knew that there were pending applications challenging his jurisdiction and that a date had already been given by the court for all parties to appear,” he said.

Meanwhile, an Islamic cleric, Alhaji Aminulahi Seriki, on Sunday, June 11 called on Nigerians, particularly Muslims to use the opportunity of Ramadan to pray for quick recovery of President Muhammadu Buhari.

Seriki, assistant Imam, Ansarul-deen Mosque, Fadeyi, Lagos, made the call at an annual Ramadan Lecture, entitled an annual Ramadan Lecture, entitled ‘The Impact of Prayers’.
